Bookkeeping and Accounting for Family Law Firms

Family law practices handle some of the most emotionally charged matters in the legal profession, and the financial side of the practice needs to be just as carefully managed. Divorce, custody, adoption, and support cases often involve retainers that are drawn down over months, frequent billing disputes, and clients under significant financial stress. A&W Associates provides bookkeeping built for family law firms to help keep your billing organized, your trust records reconciled, and your receivables current.

Retainer Management and Evergreen Retainers

Most family law matters start with a retainer deposited into trust. We track every retainer by client, record each draw as fees are earned, and flag accounts that need to be replenished under evergreen retainer agreements. How retainers are structured is governed by your fee agreement and the applicable bar rules, and our bookkeeping follows the terms your firm has set. Every earned-fee transfer is documented and tied to a specific client and invoice.

IOLTA and Trust Account Compliance

Bar rules on client funds are strict, and family law clients are quick to question every charge. We maintain accurate client ledgers and perform monthly three-way reconciliation of your IOLTA and trust accounts, so your records are ready for an audit or a client inquiry.

Accounts Receivable and Collections Support

Unpaid balances are one of the biggest challenges in family law. We monitor aging receivables, prepare clear client statements, and give you regular reports on which accounts are past due so you can address them before they turn into write-offs.

Tracking Hourly Work and WIP

Family law work is typically billed hourly, which means unbilled time is money waiting to be collected. Our work-in-progress (WIP) accounting helps you see how much unbilled work is sitting on each matter and how quickly it converts to cash.

Fee Disclosure and Fee Shifting in Major Family Law Markets

In many divorce cases, the court looks at how much each side has paid its lawyers and who should contribute. When that happens, a family law firm’s billing records become evidence. Here is how that plays out in four large markets where we work with firms remotely.

New York: Manhattan, Westchester, and Long Island

New York Domestic Relations Law §237 creates a rebuttable presumption that counsel fees will be awarded to the less monied spouse. Both parties and their attorneys must file affidavits disclosing the fee arrangement, including the retainer, amounts paid and still owed, and the hourly rate. Clean retainer ledgers and invoice histories make those affidavits faster to prepare and easier to support.

Illinois: Chicago, DuPage County, and Lake County

Illinois law lets courts order interim attorney’s fees during a dissolution case so both spouses can participate on a more equal footing. Petitions for interim fees rely on accurate records of fees incurred, paid, and outstanding, which is exactly what our client-level billing reports provide.

Texas: Houston, Dallas, Austin, and San Antonio

Texas is a community property state, and temporary orders in a divorce can include interim attorney’s fees. When fees are paid from an interim award or by a third party, we record the source of each payment so the client ledger shows who paid what, and when.

Florida: Miami, Fort Lauderdale, Tampa, and Orlando

Under Florida Statutes §61.16, a court may order one party to pay the other’s attorney’s fees after considering both parties’ financial resources. Fee motions in Florida draw on the same invoice and payment detail, so we keep billing histories current and easy to export.
